REFUND POLICY

Refund, correction, cancellation and rescheduling terms.

Effective Date: October 30, 2026

Last Update: September 29, 2026

Version: 1.0

1. Introduction and Application

1.1 This Refund and Cancellation Policy applies to requests for correction, re-performance, credit, refund, cancellation or rescheduling relating to services supplied by BABEL LINKERS (PTY) LTD.

1.2 This Policy applies to every client and forms part of the applicable quotation, engagement, order, service agreement or other arrangement governing the relevant service. Acceptance of a quotation, payment or instruction to proceed confirms the client's agreement to the applicable terms, subject to any rights that cannot lawfully be excluded.

1.3 This Policy is intended to operate together with the Consumer Protection Act 68 of 2008, Electronic Communications and Transactions Act 25 of 2002, Protection of Personal Information Act 4 of 2013 and other applicable law. Nothing in this Policy is intended to waive or unlawfully limit a statutory right.

2. Definitions

For purposes of this Policy:

Business Day means a day other than a Saturday, Sunday or public holiday in South Africa.
Deliverable means the translation, certified translation, sworn translation, transcript, document or other agreed output supplied to the client.
Interpreting Services means spoken-language interpretation supplied in accordance with an agreed booking or engagement.
Sworn Translation means a translation supplied with the applicable sworn declaration, certification or other agreed formal authentication.
Third-Party Costs means reasonable costs already incurred from third parties in connection with a client engagement.
Translation Services means professional translation, editing, proofreading, certification, localisation or related language services.

3. Nature of Services

Translation, sworn translation and interpreting are professional services rather than standard retail goods. Many assignments are customised, time-sensitive and prepared specifically for a particular client or purpose.

Completed and delivered professional services therefore cannot ordinarily be returned in the same manner as physical goods. Depending on the circumstances and applicable law, an appropriate remedy may instead include correction, re-performance, credit or refund.

4. Quality Guarantee and Right to Correction

Babel Linkers undertakes to perform professional language services with reasonable care, skill and attention appropriate to the agreed service.

Where a client believes that a delivered translation contains a material error, the client should notify Babel Linkers within 14 calendar days of delivery.

The notification should identify the relevant portion of the deliverable, explain the alleged error and, where reasonably possible, provide the client's preferred or required correction.

Babel Linkers will aim to investigate the complaint within 5 Business Days.

Where a material error attributable to Babel Linkers is established, we may correct or re-deliver the affected work. If the matter cannot reasonably be remedied, an appropriate partial or full refund may be considered, subject to the circumstances and applicable law.

Nothing in this section is intended to limit any applicable consumer rights relating to quality of services.

5. Matters Not Constituting Errors

The following will not ordinarily constitute a service error:

Changes in stylistic preference after delivery.
Changes to the source document after work has commenced or been completed.
Changes to client instructions after delivery.
Ambiguities, omissions or errors contained in the source material.
Source documents that are illegible or materially incomplete.
Rejection by a third party for reasons unrelated to the accuracy of the translation.
Failure by the client to communicate the intended purpose, destination, authority or required format before work begins.

6. Sworn and Certified Translations

Sworn and certified translations are bespoke professional services prepared according to the information and documents supplied by the client.

Such services are not ordinarily returnable or exchangeable once supplied, except where a material error attributable to Babel Linkers is established.

Depending on the circumstances, the remedy may include retranslation, re-certification, re-issuance or another appropriate corrective measure.

Babel Linkers is not responsible for the authenticity, validity or legal status of the original document supplied by a client.

7. Interpreting Services — Cancellation and Rescheduling

Cancellation charges may apply to interpreting bookings because interpreters reserve specific dates and times and may decline other work in reliance on a confirmed booking.

More than 5 Business Days before the booking: no cancellation charge, except reasonable non-recoverable third-party costs already incurred.
2 to 5 Business Days before the booking: up to 50% of the agreed interpreting fee may be charged.
Less than 2 Business Days before the booking, or a client no-show: up to 100% of the agreed interpreting fee may be charged, subject to applicable law.

Minimum booking periods, overtime, after-hours charges and other agreed booking conditions may apply.

Where Babel Linkers cancels an interpreting engagement, we will make reasonable efforts to provide a suitable replacement. If a suitable replacement cannot reasonably be provided, the affected service fee will be refunded.

Rescheduling may be subject to availability and reasonable additional charges where applicable.

Quality complaints relating to interpreting should preferably be raised within 48 hours of the service. Where a material service failure is established, an appropriate remedy may include replacement, credit or partial refund.

8. Cooling-Off Rights

Where a transaction is subject to a statutory cooling-off right, the applicable statutory period and exceptions will apply.

Where applicable law provides a cooling-off period for direct marketing transactions, the relevant statutory period will apply.

Where a client expressly requests that services commence before the expiry of an applicable cooling-off period, the client may be responsible for reasonable work already performed and non-recoverable third-party costs, to the extent permitted by law.

9. Refund Procedure

Refund requests should be submitted in writing and should include the relevant quotation, invoice or reference number, the client's contact details and the reason for the request.

Babel Linkers will aim to acknowledge a refund request within 2 Business Days.

We will aim to communicate a decision within 10 Business Days, subject to the complexity of the matter and the availability of information.

Where a refund is approved, the payment will ordinarily be processed within 15 Business Days after approval, subject to payment-provider and banking processes.

Reasonable non-refundable amounts may be deducted where permitted by law and where they relate to services already performed or third-party costs already incurred.

10. Non-Refundable Amounts

Subject to applicable law, the following may not be refundable to the extent they have already been incurred or performed:

Reasonable third-party costs.
Work already completed.
Rush or after-hours work already delivered.
Reasonable deposits or booking fees.
Approved and delivered professional services.

11. Confidentiality, Records and Return of Documents

Client information and documents will be handled in accordance with applicable confidentiality and data-protection obligations.

Where original physical documents are held by Babel Linkers and must be returned by courier, the client may be responsible for reasonable courier costs where applicable.

Records may be retained where required by law, professional obligations, contractual requirements, dispute resolution requirements or legitimate business record-keeping needs.

12. Limitation of Liability

Subject to applicable law, Babel Linkers' aggregate liability arising from a particular service will not exceed the fees actually paid for that specific service.

Nothing in this Policy excludes or limits liability where such exclusion or limitation is prohibited by law, including liability that cannot lawfully be excluded for gross negligence, fraud, wilful misconduct or statutory consumer rights.

Subject to applicable law, Babel Linkers will not be liable for indirect or consequential loss arising from matters beyond the agreed scope of the service.

Babel Linkers will not be responsible for delays or failures caused by events reasonably outside its control.

13. Complaints and Dispute Resolution

Clients are encouraged to raise complaints directly with Babel Linkers first so that the matter can be investigated and resolved where possible.

Babel Linkers will aim to work towards resolution within 30 days, depending on the nature and complexity of the complaint.

Where appropriate, the parties may consider mediation or another form of alternative dispute resolution before formal proceedings, unless urgent legal relief is required.

Nothing in this Policy prevents a consumer from exercising a right to approach a competent regulator, consumer authority, ombud, tribunal or court where such right exists.

14. General

14.1 Amendments

Babel Linkers may update this Policy from time to time. The current version will be published on the website.

14.2 Governing Law and Jurisdiction

This Policy is governed by the laws of the Republic of South Africa, subject to applicable statutory rights. The parties submit, where legally permissible, to the jurisdiction of the Western Cape High Court or another competent court.

14.3 Severability

If any provision of this Policy is found to be invalid or unenforceable, the remaining provisions will continue to operate to the extent permitted by law.

14.4 Entire Policy

This Policy forms part of the applicable agreement between Babel Linkers and the client. Where a specific written agreement conflicts with this Policy, the applicable agreement will govern to the extent legally permissible.

Nothing in this Policy is intended to limit any consumer right that cannot lawfully be excluded.
